Job Summary:
This position is responsible for division-wide Title IX compliance with all local, state, and federal laws and related School Board policies and regulations prohibiting non-discrimination and harassment of PWCS students and staff. This position develops and implements professional development/trainings and protocols regarding all sexual misconduct, sex-based discrimination, and harassment prevention involving students and staff. The Title IX Coordinator will design communications, resources, and supports to ensure PWCS staff and students understand their rights, and where applicable, their responsibilities under the law. This position is responsible for determining how to respond to Title IX complaints, including recommendations for investigation and the resolution of complaints. This position also collaborates with PWCS leadership to identify and address systemic challenges to climate and culture within PWCS schools and departments.
The Title IX Coordinator also has oversight of the Division’s compliance with other federal non-discrimination statutes as they apply to PWCS students and/or staff, with the exception of those laws governing the provision of special education services, which are the responsibility of the Associate Superintendent for Special Education. This position will oversee the resolution of all student complaints of Title IX discrimination or harassment, report such findings, and make recommendations to the administration on preventing recurrence. This position monitors and compiles data relating to all Title IX compliance and implementation efforts, analyzes such data, and reports findings to the administration. This position is responsible for drafting and updating applicable policies and regulations and provides guidance and training for the Superintendent’s staff and PWCS employees on Title IX compliance issues affecting students and staff. This position is responsible, in collaboration with the Office of Division Counsel, for coordinating the Division’s response to any formal complaints filed with any local, state, or federal administrative agency alleging discrimination or harassment of students. This position will lead the implementation of this work through the PWCS Vision 2025 strategic plan, and subsequent plans, as well as the PWCS diversity, equity, and inclusion and compliance frameworks.
Essential Responsibilities Specific to this Role:
- Provides ongoing professional development and/or training with PWCS administration and staff regarding requirements of those federal, state, and local statutes protecting students and staff from discrimination and harassment and ensuring a positive climate and culture throughout all schools and departments in the provision of educational programs and services.
- Develops, revises, and updates all School Board policies and regulations prohibiting non-discrimination and harassment of students and staff consistent with local, state, and federal laws as related to Title IX compliance.
- Develops, facilitates, monitors, and evaluates the impact of training and education on the federal Title IX rule to all stakeholder groups.
- Reviews findings and recommendations of Compliance Investigators, reviews the adequacy of remedial measures taken in response to such complaints, reviews proposed sanctions for sexual misconduct before imposed to ensure adequacy to prevent a recurrence, conducts a review of evidence and makes the final decision on whether an offense has violated School Board policies prohibiting discrimination or harassment based on sex.
- Provides support to site-based administrators and department managers based.
- Reports findings and decisions on employee and student harassment and sexual misconduct matters. Will make recommendations for remedial measures, to the Chief Equity Officer, Deputy Superintendent, and Division Superintendent.
- Coordinates and collaborates with the resolution of all employee and student discrimination and harassment complaints, as applicable, with the Department of Human Resources (employee misconduct), the Office of Risk Management and Security Services (investigations, CPS, and police matters), the PWCS Office of Student Management and Alternative Programs (student discipline), the Director of Student Services (student supports), and the police and juvenile justice courts and authorities.
- Works closely with the PWCS Office of Division Counsel regarding the legal interpretation and application of various laws, policies, and regulations.
- Ensures ongoing compliance with non-discrimination statutes by collecting and analyzing data, writing comprehensive reports, and ensuring confidential maintenance of records.
- Identifies systemic problems relating to discrimination complaints and reports directly to the Supervisor of Compliance and the Director of Diversity, Equity, Inclusion, and Compliance.
Requirements
Minimum of Bachelor's Degree in psychology, public policy, social work, urban education, or other related areas plus three years experience with duties and responsibilities directly related to those described, resolutions of Title IX, and civil rights are strongly preferred some portion working in the development of systems to address, reduce, and monitor discrimination, harassment, and retaliation and experience and familiarity with the operations and procedures of a PreK-12 public school division or public university are essential. Certification by the Association of Title IX Administrators (ATIXA) or comparable certification/training preferred and required after hire.
Knowledge, Skills, Abilities, and Behaviors:
- Knowledge of Title IX and all federal regulations and guidance governing compliance with Title IX, including familiarity with the duties and roles of Title IX investigators and Title IX decision-makers.
- Demonstrated writing and analytical skills.
- Strong knowledge of all local, state, and federal nondiscrimination laws applicable to Pre-K-12 students and employees.
- Ability to work collaboratively with other members of administrative staff and diverse community members, including public advocacy groups and governmental agencies, such as police, child protective services, and the juvenile justice system.
- Ability to analyze data and prepare reports.
- Excellent collaborative and communication skills.
- Ability to manage highly sensitive and confidential information.
- Expertise in the investigation and resolution of student and staff discrimination and harassment concerns, including public school or college/university compliance with Title IX.
- Familiarity with the requirements of the Family Educational Rights and Privacy Act (FERPA), IDEA, Section 504 of the Rehabilitation Act of 1973, ADA Amendments Act of 2008, and Virginia laws regarding student disciplinary procedures.
